On November 13, 2017 (the "Petition Date"), Preferred Care Inc. and thirty-three affiliated debtors (together, the "Preferred Care Debtors") filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code.

On July 6, 2018, thirty-two additional debtors (the "G P Debtors") filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code (all cases collectively referred to as the "Debtors"). The Debtors' bankruptcy cases are jointly administered under case number 17-44642 and are pending before the Honorable Mark X. Mullin in the U.S. Bankruptcy Court for the Northern District of Texas.

Why did I receive the Notice of Chapter 11 Bankruptcy Filing and Amended Order Granting Motion for Joint Administration?

• The Notice of Chapter 11 Bankruptcy Filing and the accompanying Amended Order Granting Motion for Joint Administration were sent to all persons and entities with whom Preferred Care Inc. and affiliated Debtors (together, the "Debtors") have, or may have done, business with in the recent past.

• Your name and address were supplied by the Debtors for purposes of providing notice of these Chapter 11 case filings.  

What is a Proof of Claim?

• A Proof of Claim is the official form that creditors or other interested parties may use to submit a prepetition claim or demonstrate amounts owing against the Debtors prior to November 13, 2017.

• Each Proof of Claim must be signed by the creditor, or by an authorized agent of the creditor if the creditor is not an individual. It is recommended you attach any supporting documents on which the claim is based or an explanation as to why such documents are not available.

• Mere receipt of the Notice of Chapter 11 Bankruptcy Filing does not mean you necessarily have a claim against the Debtors. Rather, you should only submit a Proof of Claim if you believe you have an unpaid balance that arose on or before November 13, 2017. Please check your records carefully and proceed accordingly.

• The decision to file a Proof of Claim is a legal decision. Neither the Debtors, its lawyers in these Chapter 11 proceedings or JND is permitted to advise or assist you in this process. Rather, it is a decision you must make on your own. To the extent necessary, it is recommended you seek your own legal counsel in making this decision.

• Instructions as to how to fill out the Proof of Claim form can be accessed HERE. Please read them carefully.

Does my Proof of Claim need to be received or stamped by a specified deadline? 

• All Proofs of Claim must be received by JND on or before the deadline of April 12, 2018.

• Proofs of Claim may be sent via hand-delivery, USPS or overnight mail to:

• Proofs of Claim will be deemed timely only if actually received by the Debtor’s claims agent, JND, on or before April 12, 2018. Proofs of Claim will not be accepted by fax or email.

Am I required to submit a Proof of Claim form or will I automatically be paid for the outstanding prepetition amount(s) that I am owed by the the Debtors?

• You may file a Proof of Claim if you believe you have an unpaid claim against the Debtor(s) that arose before November 13, 2017, and this claim is not listed in the Debtor's Schedules of Assets and Liabilities (the “Schedules,” which will be filed with the Court and appear on this website on January 6, 2018). If you have an unpaid claim that is not listed in the Debtors’ Schedules and do not file a Proof of Claim by April 12, 2018, you may not be entitled to receive any payment on your claim if such claim is allowed and once a Chapter 11 Plan is confirmed.

What is the Meeting of Creditors?

• The "Meeting of Creditors" is a meeting held by the U.S. Trustee for the interested creditors in all Chapter 11 Bankruptcy cases. The U.S. Trustee and creditors may question the Debtors under oath at the meeting concerning the Debtors’ acts, conduct, property, and the administration of the cases.

• It is not required that a creditor or potential creditor participate in the Meeting of Creditors in order to submit a Proof of Claim.

These cases have not been substantively consolidated, meaning each and every debtor has a unique and separate list of creditors. If you believe you are a creditor of one (or more) of the Preferred Care Debtor facilities as well as one (or more) of the GP debtors, you must file a separate claim against each and every debtor.
